Terms and Conditions of Smart Ocular Travels

Welcome to OcularTravels.com, operated by Smart Ocular Travels DBA Ocular Travels (referred to as “we,” “us,” or “our”). By booking any tour, travel package, or service through our website, you acknowledge and agree to the following Terms and Conditions. These Terms govern all travel-related transactions between you and Smart Ocular Travels, a registered California Seller of Travel (CST: 2156105-40).
1. General Information
- All travel services offered by Ocular Travels are subject to these Terms and Conditions.
- By accessing and booking through our platform, you agree to abide by these Terms.
2. Seller of Travel Registration
- Smart Ocular Travels is a registered Seller of Travel with the California Department of Justice, registration number 2156105-40.
- Registration as a seller of travel does not constitute approval by the State of California.
3. California Travel Consumer Restitution Fund (TCRF)
- If you are a California resident and made your payment for travel services in California, you may be eligible for a refund from the California Travel Consumer Restitution Fund (TCRF) in the event of loss due to:
- Bankruptcy or insolvency of the seller of travel.
- Cessation of operations or failure to provide agreed-upon services.
- To file a claim, you must:
- Be owed at least $50.
- Submit a claim within 12 months after the scheduled completion date of travel.
- Agree to waive civil remedies against the registered seller of travel for the same issue.

4. Cancellation and Refund Policy
4.1. Right to Prompt Refund
In accordance with California law:
- Customer-Initiated Cancellation: If you cancel your booking, notify us in writing. Refunds will be processed within 30 days from the receipt of your cancellation notice, minus any applicable cancellation fees (see Section 4.2).
- Company-Initiated Cancellation: If we cancel a tour or service for reasons such as low participation, safety concerns, or unforeseen circumstances, we will notify you immediately and provide a full refund within 30 days of cancellation notice.
4.2. Cancellation Fees
- Cancellations made 60 days or more before the departure date: Full refund, minus a 10% cancellation fee.
- Cancellations made 7-59 days before the departure date: Refund subject to a 50% cancellation fee.
- Cancellations made less than 7 days before the departure date: No refunds will be issued, except as required by California law.
5. Payment Terms
- Full payment for travel services is required at the time of booking unless otherwise specified.
- Payments can be made securely through our website at OcularTravels.com.
6. Pricing and Availability
- All prices are subject to change until full payment is received.
- While we strive to maintain accuracy, errors in pricing or availability may occasionally occur.
- If a pricing or availability error is identified, we will notify you promptly. You may choose to:
- Accept the revised price.
- Cancel your reservation and receive a full refund.
7. Travel Insurance
- We strongly recommend purchasing comprehensive travel insurance to cover:
- Trip cancellations.
- Medical emergencies.
- Lost or damaged luggage.
- It is the traveler’s responsibility to secure adequate coverage.
8. Changes to Itinerary
- We reserve the right to modify or cancel any part of the itinerary due to factors beyond our control, including but not limited to:
- Weather conditions.
- Safety concerns.
- Operational requirements.
- If changes occur, we will provide:
- Suitable alternatives.
- Refunds for any unused portions of the tour, as applicable.
9. Health and Safety
- Travelers must comply with health and safety requirements, including but not limited to:
- Vaccination mandates.
- Mask-wearing.
- Social distancing protocols.
- Non-compliance may result in exclusion from certain tour activities without refund.
10. Liability
- While we strive to ensure a safe and enjoyable experience, Smart Ocular Travels is not responsible for:
- Injuries, illnesses, or property loss during the tour unless caused by our negligence.
- Delays or cancellations due to circumstances beyond our control.
11. Travel Documentation
- Travelers are responsible for obtaining necessary travel documentation, including:
- Valid passports.
- Visas, if required.
- We are not responsible for cancellations or delays caused by insufficient or incorrect documentation.
12. Governing Law
- These Terms and Conditions are governed by the laws of the State of California.
- Any disputes will be resolved in the courts located in California.
13. Promotional Giveaways Terms and Conditions
1. Eligibility Participation in the Ocular Travels Promotional Giveaway (the “Giveaway”) is open to individuals who fully attend the designated event or session, provide valid contact information, and meet the following criteria:

Must reside in a region where Ocular Travels can ship the promotional item.
2. Giveaway Details Each eligible participant who meets the requirements outlined in Section 1 will receive one (1) Nepalese incense pack (the “Item”). This offer is limited to:

3. Redemption Requirements To receive the Item, participants must:

Fully attend the specified Ocular Travels event or session.

Provide complete and accurate contact and mailing information as requested.
4. Shipping and Delivery The Item will be mailed to the address provided by the participant. Ocular Travels is not responsible for:

Items lost, stolen, or damaged during transit.

Incorrect or incomplete mailing addresses supplied by participants.
5. Offer Period The Giveaway is valid while supplies last or until Ocular Travels cancels the offer. Ocular Travels reserves the right to terminate the Giveaway at any time without prior notice.
6. Limitation of Liability Ocular Travels is not liable for:

Any delays or failures in delivery caused by events outside its control.

Any loss or damage resulting from participation in the Giveaway or use of the Item.
7. Responsibility for Item Use Ocular Travels is not responsible for any misuse of the Item or any consequences arising from its use after it has been delivered to the participant. The participant assumes all responsibility for the safe and appropriate use of the Item.
8. Rights Reserved Ocular Travels reserves the right to:

9. Agreement to Terms By participating in the Giveaway, participants agree to these Terms and Conditions and acknowledge that they have no claim or recourse against Ocular Travels related to the Giveaway.
